AG approves most of Provincetown's pedicab license bylaw
The Massachusetts Attorney General approved most of Provincetown's new pedicab licensing bylaw on Oct. 5, striking one subsection, the town announced Oct. 20. The bylaw sets annual caps on pedicab vehicle licenses and creates a lottery for extra or surrendered licenses.
The Town of Provincetown announced Oct. 20 that the Massachusetts Attorney General has approved, in part, a bylaw amendment setting limits on pedicab licenses in town.
The amendment, Article 32, was adopted as amended at the April 6, 2026 Annual Town Meeting. The Attorney General approved it on Oct. 5, 2026, under state law governing town bylaws, but disapproved one subsection, 9-8-4-4, which is not included in the bylaw as published.
Under the approved bylaw, the town's Licensing Board may issue up to 45 annual pedicab vehicle licenses in the first calendar year after the bylaw takes effect, up to 40 in the second year, and up to 35 in the third year and every year after that. Starting Nov. 1 each year, the Select Board may raise that limit for the following year, but only after notice and a public hearing, and the new limit cannot exceed 45 licenses.
The bylaw also creates a lottery system for distributing any remaining or surrendered pedicab vehicle licenses to current or prospective owners who meet licensing requirements. All pedicab licenses expire annually on Dec. 31 and cannot be transferred or sold, though the Licensing Board can issue rules on how a license is affected by a change in ownership of a pedicab business.
Copies of the approved bylaw and the Attorney General's decision are available from the Office of the Town Clerk at Provincetown Town Hall, 260 Commercial Street, or on the town's website. The notice was signed by Town Clerk Elizabeth D. Paine and is set to be published in the Provincetown Independent on Oct. 29 and Nov. 5, 2026.
